Welcome to MessGo. These Terms & Conditions (“Terms”) govern your use of our website messgo.com.au (the “Site”) and the cleaning services provided by MessGo (“we”, “us”, “our”, “MessGo”). By accessing or using the Site or by booking or engaging in any service through us, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use our Site or services.
1. Definitions
In these Terms:
- “Client”, “you”, “your” means the person or entity who uses the Site or books services via the Site.
- “Services” means any cleaning services (office cleaning, house cleaning, medical cleaning, window cleaning, floor cleaning, room cleaning, etc.) offered by MessGo.
- “Booking” means an appointment or scheduled service request placed by you through the Site or otherwise.
- “Price” means the amount payable by you for Services as quoted or agreed.
- “Site Content” includes all text, images, graphics, logos, software, designs, data, and other materials on the Site.
2. Use of the Site & Eligibility
2.1 You must be at least 18 years of age and legally capable of entering a binding contract to use the Site and book Services.
2.2 You agree not to use the Site for any unlawful or prohibited purposes.
2.3 We may suspend or terminate your access to the Site at any time if you breach these Terms.
3. Booking & Service Terms
3.1 Request & Confirmation
- You may submit a Booking request via the Site or by contacting us directly.
- We will confirm your Booking (via email, SMS, or phone) when we have accepted it. The Booking is not effective until confirmed.
- We reserve the right to refuse or cancel any Booking at our discretion (e.g. location outside service area, safety concerns).
3.2 Scope of Services
- We will perform the Services as described in the Booking confirmation (e.g. type of cleaning, date/time, location, special instructions).
- We strive to provide high-quality, professional cleaning. Minor variations or adjustments may occur depending on circumstances (e.g. site conditions, weather, access).
3.3 Client Obligations
- You must provide safe and lawful access to the premises at the scheduled time.
- You must secure or remove any personal, fragile, or valuable items in the area to be cleaned. MessGo is not liable for damage to items left out in the open.
- You must notify us of any special hazards, pets, health or safety risks at the premises in advance.
- You must ensure that the premises are in a condition that allows safe and reasonable performance of the Services.
3.4 Price and Payment
- The Price will be quoted at or prior to booking and may include additional fees (e.g. travel, specialized cleaning).
- Payment is due as specified in the confirmation (e.g. before or immediately after service).
- We accept the payment methods listed on the Site (credit card, bank transfer, or other).
- If payment is not made on time, we may withhold service or charge interest/late fees (to the extent permitted by law).
3.5 Changes, Cancellations and Rescheduling
- You may request a change, cancellation or rescheduling of a Booking, subject to notice.
- If you cancel without giving adequate notice (e.g. less than [X] hours), a cancellation fee may apply.
- We may reschedule or cancel a Booking in certain circumstances (e.g. inclement weather, staff shortages). We will provide you notice and try to rebook promptly.
4. Liability & Disclaimers
4.1 General Liability
- To the fullest extent allowed under Australian law, MessGo’s liability to you for any loss or damage arising from or related to the Services or Site is limited to the Price paid for the affected service.
- We exclude (where permitted by law) indirect, incidental, consequential, or special damages.
4.2 Damage or Loss
- We will take reasonable care in providing services. However, you must promptly notify us in writing of any damage, loss or unsatisfactory work.
- We may investigate and, if we accept liability, either repair, re-perform, or refund (at our option).
- MessGo is not responsible for pre-existing damage or defects, items left unsecured, or issues outside our control.
4.3 Force Majeure
- We are not liable for any failure or delay caused by events beyond our reasonable control (e.g. natural disasters, acts of government, strikes, pandemics).
5. Intellectual Property
5.1 All rights, title and interest in the Site Content (including copyrights, trademarks, designs) are owned by MessGo or its licensors.
5.2 You may view, download or print content from the Site for your personal, non-commercial use only. Any other use (reproduction, distribution, modification) is prohibited without prior written permission.
5.3 “MessGo”, the stylized logo and other marks are trademarks of MessGo.
6. Privacy
Your use of personal information through the Site and in connection with our Services is governed by our Privacy Policy. By agreeing to these Terms, you also agree to the terms of our Privacy Policy.
7. Reviews, Photos & Feedback
- You may be asked to provide feedback, reviews or photos of the work done.
- By submitting such content, you grant MessGo the right to use, reproduce and display them for marketing, website, social media, or internal purposes.
- You warrant that you own the rights to any submitted content and that it does not violate any third-party rights.
8. Dispute Resolution & Governing Law
- These Terms are governed by the laws of the State of Victoria, Australia (or the state in which the service is provided).
- Any dispute arising out of or relating to these Terms or our Services will be subject to the exclusive jurisdiction of the courts of that jurisdiction.
- Prior to litigation, both parties agree to attempt good faith negotiation or mediation.
9. Changes to Terms & Conditions
We may revise or update these Terms from time to time. The revised Terms will take effect when posted on the Site (with a new effective date). Your continued use of the Site or Services after that point constitutes acceptance of the new Terms.
10. Severability & Waiver
- If any provision of these Terms is held invalid or unenforceable, that provision will be severed, and the rest remain in force.
- Our failure or delay to enforce any right or remedy under these Terms does not constitute a waiver of that right.
